Christmas Public Holidays

Christmas Day 2016 - No Public Holiday Entitlement for Victorian Employees

Victoria is the only state in Australia that has not declared 25 December 2016 to be a public holiday. Rather, as Christmas Day falls on a Sunday this year, it is the next working day (Tuesday 27 December) that has been declared as being the Christmas Day public holiday.

While all other States have declared both Sunday 25 December and Tuesday 27 December to be a public holiday, in Victoria only Tuesday 27 December will be the observed public holiday for Christmas Day. The Boxing Day Public Holiday on Monday 26 December will also continue to apply.

This means that any Victorian based employee who works on Christmas Day itself (Sunday 25 December 2016) will not be entitled to payment at public holiday rates for work performed on that day. However the normal applicable penalty rates for Sunday work provided under an applicable award will continue to apply.

The public holiday penalty rates will instead be paid only to those employees who are required to perform work on Tuesday 27 December 2016.

The public holidays that apply throughout the Christmas/New Year Period are:

 Australian Capital Territory

  • Sunday 25 December - Christmas Day
  • Monday 26 December - Boxing Day
  • Tuesday 27 December - Additional Day (applies as Christmas Day falls on a weekend)
  • Sunday 1 January - New Year's Day
  • Monday 2 January - Additional Day (applies as New Year's Day falls on a weekend) 

New South Wales

  • Sunday 25 December - Christmas Day
  • Monday 26 December - Boxing Day
  • Tuesday 27 December - Additional Day (applies as Christmas Day falls on a weekend)
  • Sunday 1 January - New Year's Day
  • Monday 2 January - Additional Day (applies as New Year's Day falls on a weekend)

 Northern Territory

  • Sunday 25 December - Christmas Day
  • Monday 26 December - Boxing Day
  • Tuesday 27 December - Additional Day (applies as Christmas Day falls on a weekend)
  • Monday 2 January - New Year's Day (substitute for Sunday 1 January)

Queensland

  • Sunday 25 December - Christmas Day
  • Monday 26 December - Boxing Day
  • Tuesday 27 December - Additional Day (applies as Christmas Day falls on a weekend)
  • Sunday 1 January - New Year's Day
  • Monday 2 January - Additional Day (applies as New Year's Day falls on a weekend)

South Australia

  • Saturday 24 December - Christmas Eve (from 7pm to midnight)
  • Sunday 25 December - Christmas Day
  • Monday 26 December - Christmas Day (additional day for Sunday 25 December)
  • Tuesday 27 December - Boxing Day / Proclamation Day (additional day as 26 December is the Christmas Day public holiday)
  • Sunday 1 January - New Year's Day
  • Monday 2 January - Additional Day (applies as New Year's Day falls on a weekend)

 Tasmania

  • Sunday 25 December - Christmas Day
  • Monday 26 December - Boxing Day
  • Tuesday 27 December - Additional Day (applies as Christmas Day falls on a weekend)
  • Sunday 1 January - New Year's Day
  • Monday 2 January - Additional Day (applies as New Year's Day falls on a weekend)

 Victoria
